1. Nature of Service
SpotTab provides a software-as-a-service (SaaS) platform, including all associated subdomains (e.g., menu.spottab.com) and related digital properties (collectively, the “Platform”), that facilitates digital interactions between guests and hospitality venues ("Merchants").
The Platform is provided as a digital alternative to traditional physical service methods (such as paper menus) and is not intended to be a mission-critical replacement for such methods.
2. Limitation of Platform Role
SpotTab provides a technical platform to facilitate ordering. SpotTab does not prepare, handle, or deliver food.
- Merchant Liability: The Merchant is the sole Merchant of Record and is exclusively responsible for compliance with all health, safety, and labeling laws, including but not limited to food allergy disclosures, ingredient accuracy, and product quality.
- Service Failures: The Platform is provided strictly "AS-IS" and "AS-AVAILABLE" without any guarantee of continuous operation. Should the Platform experience downtime, maintenance outages, or technical errors, you should utilize the Merchant's alternative physical service methods. SpotTab shall have no liability for any perceived loss of service, missed orders, inconvenience, or delay.
3. Payments & Disputes
Any payment made via the Platform is a direct transaction between you and the Merchant, facilitated by proprietary third-party secure processing systems (such as Stripe). SpotTab is not responsible for transaction failures, chargebacks, or disputes between the Merchant and Customer.
All disputes regarding order accuracy, refunds, or payment errors must be resolved directly with the Merchant. SpotTab does not have the authority to issue refunds or mediate disputes on behalf of the Merchant.
4. Prohibited Conduct
To maintain the integrity and security of the Platform, you are strictly prohibited from:
- Automated Access: Using any robot, spider, scraper, or other automated means to access the Platform for any purpose, including data collection (scraping).
- Malicious Intent: Attempting to interfere with the proper working of the Platform, including spamming, botting, or submitting fraudulent orders.
- Security Circumvention: Attempting to bypass any measures we may use to prevent or restrict access to the Platform.
SpotTab reserves the right, in its sole discretion and without notice, to block or terminate access to the Platform (via IP blocking or other technical identifiers) for any user suspected of violating these terms or engaging in conduct harmful to the Platform or its Merchants.
5. Intellectual Property
The structure, organization, and code of the Services are valuable trade secrets and confidential information of SpotTab. User shall not, and shall not attempt to, reverse engineer, decompile, or disassemble the Services.
All subdomains issued (e.g., [name].spottab.com) remain the exclusive property of SpotTab. No rights are granted to users other than the limited right to browse the Merchant's digital content.
